1. Acceptance of Terms
These Terms of Use (“Terms”) constitute a legally binding agreement between you (“Participant,” “You,” or “Your”) and Kumar Enterprises (GSTIN: 07AIEPK1173E1ZM), operating as AI Business Partners (“Company,” “We,” “Us,” or “Our”). By registering for, accessing, or participating in any workshop conducted by the Company, You acknowledge that You have read, understood, and agree to be bound by these Terms.
Mandatory Agreement: Acceptance of these Terms is a prerequisite for workshop participation. Non-acceptance will result in denial of access to workshop services.
2. Eligibility and Registration
2.1 Age Requirement: You must be at least 18 years of age to participate in workshops.
2.2 Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
2.3 Workshop Format: These Terms apply to both in-person and virtual workshops conducted via third-party platforms including but not limited to Zoom, Google Meet, and Microsoft Teams.
3. Intellectual Property Rights
3.1 Ownership:All intellectual property rights in workshop materials, content, methodologies, frameworks, tools, templates, presentations, and recordings (“Workshop Materials”) are and shall remain the exclusive property of Kumar Enterprises under:
- The Copyright Act, 1957
- The Trade Marks Act, 1999
- The Patents Act, 1970
- Other applicable Indian intellectual property laws
3.2 Limited License Grant: Subject to these Terms, we grant You a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access Workshop Materials solely for personal, non-commercial reference during the workshop period.
3.3 Prohibited Uses: You shall NOT:
- Reproduce, copy, or duplicate any Workshop Materials
- Distribute, share, or disseminate materials to third parties
- Create derivative works based on Workshop Materials
- Use materials for commercial or professional purposes without written authorisation
- Remove or alter copyright notices or watermarks
- Record sessions without prior written consent
- Upload materials to any digital platform or repository
- Use artificial intelligence tools to recreate or replicate content
3.4 Confidentiality Obligation: Workshop Materials contain proprietary information and trade secrets. You agree to maintain strict confidentiality for a period of five (5) years following workshop completion.
4. Code of Conduct
Participants shall:
- Maintain professional decorum during sessions
- Respect intellectual property rights
- Not engage in disruptive behaviour
- Comply with all applicable laws and regulations
- Not misrepresent their association with the Company
5. Payment Terms
5.1 Fee Payment: Full payment is required prior to workshop registration confirmation.
5.2 Currency and Taxes: All payments shall be made in Indian Rupees and include applicable taxes as per Indian tax regulations.
5.3 Refund Policy: Workshop fees are non-refundable. See Section 6 (Refund and Cancellation Policy) for complete details.
5.4 AI Tool Subscriptions:Workshop fees cover only the workshop itself. Any third-party artificial intelligence tools, software, or subscriptions referenced or used during or after the workshop (including but not limited to ChatGPT, Claude, Gemini, and Perplexity) are the sole responsibility of the Participant, are procured at the Participant’s own cost, and are not included in the workshop fees. The Company is not responsible for the availability, pricing, performance, or terms of service of any such third-party tool.
6. Refund and Cancellation Policy
6.1 No Refund Policy: All workshop fees paid to Kumar Enterprises are strictly non-refundable. Once payment is confirmed, no refunds shall be issued under any circumstances, including but not limited to:
- Change of mind or scheduling conflicts
- Inability to attend due to personal or professional reasons
- Dissatisfaction with workshop content, methodology, or delivery
- Technical issues on the Participant’s end during virtual sessions
- Partial attendance or early withdrawal from the workshop
6.2 No Cancellation Credit: Workshop registrations are non-transferable and non-exchangeable. No credit notes, adjustments, or transfers to future workshops shall be provided unless expressly authorised in writing by Kumar Enterprises at its sole discretion.
6.3 Company-Initiated Cancellation: In the unlikely event that Kumar Enterprises cancels a workshop due to unforeseen circumstances, the Company may, at its sole discretion, offer:
- Rescheduling to an alternative date, OR
- A credit toward a future workshop of equivalent value
Any such remedy shall constitute the Participant’s sole and exclusive recourse, and the Company shall bear no further liability.
6.4 Force Majeure: No refunds shall be issued for cancellations arising from force majeure events as described in Section 10 of these Terms.
6.5 Chargebacks and Disputes: Initiating a payment chargeback or dispute without first contacting the Company at info@aibusinesspartners.ai shall constitute a breach of these Terms and may result in legal action for recovery of the disputed amount along with associated costs.
6.6 Acknowledgement: By completing registration and payment, You expressly acknowledge and agree to this No Refund Policy and waive any right to claim a refund of workshop fees.
7. Disclaimers and Limitation of Liability
7.1 No Professional Advice: Workshop content is provided for general educational purposes only and does not constitute professional, legal, financial, or business advice.
7.2 “As Is” Provision:Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose.
7.3 Limitation of Liability:
- The Company, its directors, employees, trainers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Maximum aggregate liability shall not exceed the actual workshop fees paid by You
- Claims must be initiated within six (6) months of the incident giving rise to the claim
7.4 Risk Assumption: You acknowledge and accept all risks associated with implementing workshop learnings in Your business or professional activities.
8. Indemnification
You agree to defend, indemnify, and hold harmless Kumar Enterprises and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from:
- Your breach of these Terms
- Unauthorised use of Workshop Materials
- Violations of applicable laws
- Implementation of workshop learnings
- Third-party claims resulting from Your actions
This provision shall survive termination of these Terms as per Section 124 of the Indian Contract Act, 1872.
9. Breach and Remedies
9.1 Liquidated Damages: Unauthorised use of Workshop Materials shall result in liquidated damages of ₹5,00,000 per breach, representing a genuine pre-estimate of loss under Section 74 of the Indian Contract Act, 1872.
9.2 Criminal Liability: Violations may result in criminal prosecution under Section 63 of the Copyright Act, 1957 (imprisonment up to 3 years and/or fine up to ₹2,00,000).
9.3 Injunctive Relief: The Company reserves the right to seek injunctive relief under Order XXXIX of the Code of Civil Procedure, 1908.
10. Force Majeure
Neither party shall be liable for failure to perform obligations due to causes beyond reasonable control, including but not limited to acts of God, natural disasters, pandemic, government actions, or civil unrest.
11. Governing Law and Jurisdiction
11.1 Applicable Law: These Terms shall be governed by and construed in accordance with the laws of India.
11.2 Exclusive Jurisdiction: Courts at New Delhi shall have exclusive jurisdiction over disputes arising from these Terms.
12. General Provisions
12.1 Severability:If any provision is deemed invalid or unenforceable, it shall be modified to the minimum extent necessary while preserving the parties’ original intent.
12.2 Amendment: We reserve the right to modify these Terms with reasonable notice. Continued participation constitutes acceptance of modified Terms.
12.3 Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between the parties.
Privacy Policy
1. Introduction
This Privacy Policy (“Policy”) describes how Kumar Enterprises, operating as AI Business Partners (“Company,” “We,” “Us,” or “Our”), collects, uses, stores, and protects personal information from workshop participants (“You” or “Your”) in compliance with the Digital Personal Data Protection Act, 2023 (“DPDPA”) and other applicable Indian data protection laws.

- Platform usage data
3. Legal Basis for Processing
We process Your personal data based on:
- Consent: Obtained at the time of registration
- Contract Performance: To deliver workshop services
- Legal Obligations: Compliance with Indian laws and regulations
- Legitimate Interests: To improve our services and ensure security
4. Purpose of Data Collection
Your personal data is collected and processed for:

6. Data Storage and Retention
6.1 Storage Location: Data is stored on secure servers within India in compliance with data localisation requirements.
6.2 Retention Period:
- Registration data: 3 years from workshop completion
- Payment records: As per statutory requirements (typically 8 years)
- Workshop recordings, photographs and other Media: retained indefinitely, as set out in Section 9.6
- Marketing data: Until consent withdrawal
6.3 Data Deletion: Upon retention period expiry, personal data will be securely deleted or anonymised.
7. Your Rights Under DPDPA
You have the following rights:
- 7.1 Right to Access: Request information about personal data We hold about You
- 7.2 Right to Correction: Request correction of inaccurate or incomplete data
- 7.3 Right to Erasure: Request deletion of personal data (subject to legal obligations)
- 7.4 Right to Data Portability: Receive Your data in a structured, commonly used format
- 7.5 Right to Withdraw Consent: Withdraw consent at any time without affecting prior processing lawfulness

8. Data Security and Breach Notification
8.1 Security Measures: We implement appropriate technical and organisational measures including:
- Encryption of sensitive data
- Secure access controls
- Regular security audits
- Employee training on data protection
- Incident response procedures
8.2 Personal Data Breach Notification:In the event of a personal data breach, We shall, in accordance with the DPDPA and the rules made thereunder, notify the Data Protection Board of India and each affected participant (“Data Principal”) of the breach in the manner and within the timeframes prescribed by law. Such notice shall, to the extent then known, describe the nature and extent of the breach, its likely consequences, the measures We have taken or propose to take to mitigate it, and the contact point from which further information may be obtained.
8.3 Participant Cooperation:Where a breach arises wholly or partly from a Participant’s act or omission (including compromise of their own credentials or devices), the Participant shall promptly notify Us and cooperate in good faith with any investigation and remediation.
9. Recording, Photography & Media Rights
9.1 Consent and Grant of Rights: By registering for and attending the workshop, each participant irrevocably consents to being photographed, filmed, and audio-recorded during the event, and grants Kumar Enterprises the rights set out in this clause.
9.2 Ownership:All video recordings, audio recordings, and still photographs captured at the workshop (“the Media”), including all copyright and other intellectual property in them, are and shall remain the sole and exclusive property of Kumar Enterprises.
9.3 Use of Likeness:Each participant grants Kumar Enterprises a perpetual, irrevocable, worldwide, royalty-free, and unconditional right to use, reproduce, edit, publish, distribute, and display the Media — including the participant’s image, likeness, voice, and any statements made — for any purpose, including promotion, marketing, and advertising, across any medium now known or later developed, without limit as to time, territory, or frequency.
9.4 Waiver: Each participant waives, to the fullest extent permitted by law: (a) any right to inspect or approve the Media or its use; (b) any claim to royalties, fees, or other compensation arising from such use; and (c) any claim based on privacy, publicity, defamation, or moral rights in connection with the Media. This waiver is given freely and as a condition of attendance.
9.5 Opt-Out: A participant who does not wish to be recorded may keep their camera and microphone disabled (for virtual sessions) or notify the organisers in writing before the session begins (for in-person sessions). Kumar Enterprises will make reasonable efforts to exclude such participants from the Media, but incidental capture in wide or crowd shots is not a breach of this clause.
9.6 Retention: The Media is retained indefinitely. Kumar Enterprises is under no obligation to delete or return any Media at any time.
9.7 Minors:We do not use a Minor’s image, likeness, voice, or statements for marketing or advertising purposes. See Section 11.
10. Cookies and Tracking
Our workshop platforms may use cookies for:
- Session management
- User authentication
- Analytics (anonymised)
- Platform functionality
You may disable cookies through browser settings, though this may affect platform functionality.
11. Children’s Data
Our workshops are designed for adults aged 18 and over. A person under the age of 18 (a “Minor”) may attend only when accompanied by, and under the supervision of, a parent or lawful guardian.
11.1 Verifiable Parental Consent:We process a Minor’s personal data only after obtaining verifiable consent from the Minor’s parent or lawful guardian, in accordance with Section 9 of the DPDPA and Rule 10 of the DPDP Rules. We take reasonable measures to verify that the consenting adult is the Minor’s parent or lawful guardian (for example, by reference to identity documents or other secure verification methods).
11.2 No Tracking or Targeted Advertising: We do not undertake tracking, behavioural monitoring, or profiling of Minors, and We do not direct any advertising at Minors.
11.3 No Detrimental Processing:We do not process a Minor’s personal data in any manner that is likely to cause a detrimental effect on the well-being of the Minor.
11.4 No Marketing Use of Likeness:We do not use a Minor’s image, likeness, voice, or statements for marketing or advertising purposes (see Section 9.7).
11.5 Guardian Rights:A parent or lawful guardian may, at any time, access, correct, or request deletion of the Minor’s personal data, or withdraw consent, by contacting our Grievance Officer.
12. Cross-Border Data Transfer
Any cross-border data transfer will comply with DPDPA requirements and include appropriate safeguards.
13. Updates to Privacy Policy
We reserve the right to update this Policy. Changes will be notified via email or workshop platform. Continued participation indicates acceptance of revised Policy.
